Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pathway Discovery ("we", "us", "our"), operated at pathwaydiscovery.co. By using this service, you agree to these Terms.

1. The Service

Pathway Discovery is an AI-assisted career pathway guidance tool. You answer a short interview about your professional background, strengths, and goals, and we generate a personalised report suggesting independent career pathways that may suit your profile.

The service has two tiers:

  • Free report — a summary of your top pathway match, why it fits, and three early actions. Available at no cost.
  • Pro report — a detailed report including a 90-day roadmap, pricing guidance, client targeting strategy, curated tools, and a personalised response to your biggest concern. Available for a one-time payment of $49 AUD.

2. Eligibility

You must be 18 years or older to use Pathway Discovery. By using the service, you confirm that you meet this requirement. We primarily serve users in Australia and New Zealand, though the service is accessible globally.

3. Account and Report Access

Pathway Discovery does not use traditional accounts. Your report is identified by a unique ID and associated with the email address you provide. Access to your report is available via the link sent to that email address.

Pro reports are stored and accessible for 12 months from the date of payment. Free reports are stored for the same period. After this time, reports may be deleted. We are not responsible for your failure to save or download your report within this period.

4. Payments

Pro upgrade payments of $49 AUD are processed securely by Stripe. We do not store your payment card details. Payment is a one-time charge — there are no recurring subscriptions or hidden fees.

Prices are displayed in Australian Dollars (AUD) inclusive of any applicable GST. We reserve the right to change pricing for new reports at any time. Your payment locks in access to your specific report for 12 months at the price charged.

5. Intellectual Property

All content, software, designs, and materials on Pathway Discovery — including report templates, question flows, and the matching methodology — are owned by or licensed to us and are protected by applicable intellectual property laws.

Your survey responses are your own. By submitting them, you grant us a non-exclusive licence to use them solely for the purpose of generating your report and improving our service. We will not sell your individual responses to third parties.

Your generated report is provided for your personal, non-commercial use. You may not reproduce, distribute, or on-sell reports or any part of them.

6. Acceptable Use

You agree not to:

  • Submit false, misleading, or another person's information
  • Use automated tools to scrape, copy, or extract data from the service
  • Attempt to reverse-engineer, hack, or interfere with the service
  • Use the service for any unlawful purpose
  • Commercially exploit or resell reports without our written permission

7. Service Availability

We aim to keep Pathway Discovery available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable for maintenance, updates, or reasons outside our control. We are not liable for any inconvenience or loss caused by downtime.

8. Modifications to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the service after changes constitutes your acceptance of the revised Terms. For material changes, we will endeavour to provide reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, including the Australian Consumer Law, our total liability to you for any loss or damage arising from or in connection with your use of Pathway Discovery is limited to the amount you paid for the service (or $0 for free users).

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of income, business opportunities, or data, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot be lawfully excluded.

10. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of Australian courts.

This is the most important section to understand before using Pathway Discovery. Please read it carefully.

Suggestions, Not Professional Advice

The reports, recommendations, roadmaps, pricing estimates, and all other content generated by Pathway Discovery are AI-assisted suggestions for your consideration only. They do not constitute professional career counselling, financial advice, legal advice, employment advice, or any other form of professional advisory service.

Pathway Discovery is not a registered career counsellor, financial adviser, employment agent, or professional services firm. No qualified professional reviews your individual results before they are generated.

No Guarantee of Outcomes

We make no representation, warranty, or guarantee — express or implied — that:

  • Any pathway suggested will be suitable, achievable, or profitable for you
  • Any income ranges or pricing guidance stated in your report will be accurate for your market, skillset, or circumstances
  • Following the roadmap will result in you acquiring clients, replacing your income, or achieving any particular career outcome
  • The strategies recommended will be effective in your specific industry, location, or economic conditions

Individual results vary significantly. Your actual outcomes will depend on many factors entirely outside our control, including but not limited to: your skills and experience, local market conditions, economic environment, effort and execution, personal circumstances, and industry-specific factors.

You Are Responsible for Your Own Decisions

Any career or business decisions you make based on your Pathway Discovery report are made entirely at your own risk. We strongly encourage you to:

  • Use your report as one input among many, not as a definitive plan
  • Seek guidance from qualified career counsellors, financial advisers, mentors, or industry professionals before making significant career changes
  • Conduct your own independent research into any pathway, market, or pricing information provided
  • Consider your personal financial situation, risk tolerance, and obligations before leaving employment

AI-Generated Content

Reports are generated using AI language models. While we have designed our system to produce relevant and useful guidance, AI-generated content may occasionally contain inaccuracies, outdated information, or suggestions that are not appropriate for your specific context. You should apply your own judgement when reading your report.

Not Financial Advice

Any income figures, rate ranges, or financial projections mentioned in your report are illustrative estimates based on general market data and your stated goals. They are not financial advice. Before making decisions based on financial projections, consult a qualified financial adviser who can assess your individual circumstances.

No Liability for Career Outcomes

To the fullest extent permitted by law, Pathway Discovery, its operators, contractors, and affiliates will not be held liable for any loss, damage, or disappointment arising from career decisions made in reliance on your report. This includes, without limitation, loss of employment income, failure to acquire clients, business losses, or any other financial or personal harm.

Privacy Policy

We are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what we collect, why, and how you can access or correct it.

What We Collect

When you use Pathway Discovery, we may collect the following information:

  • Email address — provided at the end of the interview, used to send your report link and identify your report
  • Interview responses — your answers about professional background, strengths, goals, existing assets, interests, income target, availability, work style preferences, and biggest concern
  • Payment information — processed entirely by Stripe; we do not receive or store your full card details, only a Stripe-issued transaction reference
  • Usage data — basic technical information such as browser type, device type, and pages visited, collected to maintain and improve the service

We do not collect your name, phone number, physical address, or any government-issued identification as part of the standard service.

How We Use Your Information

We use your information solely to:

  • Generate your personalised career pathway report
  • Send you your report access link via email
  • Process and verify your payment (via Stripe)
  • Maintain and improve the quality of our AI models and question flows
  • Respond to enquiries you send us directly

We do not use your personal information for marketing communications without your explicit consent. We do not sell, rent, or trade your personal information to any third party.

Third-Party Service Providers

We use the following trusted third-party providers to operate the service. Each is bound by their own privacy obligations:

  • Supabase — cloud database and hosting provider, used to store your report data securely
  • Stripe — payment processing; subject to Stripe's Privacy Policy
  • Cloudflare — website hosting, CDN, and DDoS protection, and bot/abuse protection via Cloudflare Turnstile on our forms (such as the waitlist signup). Turnstile's data handling is described in Cloudflare's Turnstile Privacy Addendum.
  • AI language model providers — used to generate the content of your report based on your interview responses; your responses are transmitted to these providers solely for report generation and are not used to train their models under our agreements

Data Storage and Security

Your data is stored in secure cloud infrastructure. We use industry-standard encryption in transit (TLS/HTTPS) and at rest. Access to stored data is restricted to authorised personnel only.

While we take reasonable precautions, no method of internet transmission or electronic storage is completely secure. We cannot guarantee absolute security.

Data Retention

Your report and associated interview responses are retained for 12 months from the date your report is created. After this period, data may be permanently deleted. If you wish to request earlier deletion, contact us at [email protected].

Aggregated, de-identified data (e.g. "35% of users selected Marketing & Growth") may be retained indefinitely for product improvement purposes.

Your Rights

Under the Australian Privacy Principles, you have the right to:

  • Request access to the personal information we hold about you
  • Request correction of any inaccurate or incomplete information
  • Request deletion of your personal information (subject to legal obligations)
  • Lodge a complaint if you believe your privacy has been breached

Privacy Complaints

If you are not satisfied with our response to a privacy concern, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated effective date. We encourage you to review this policy periodically.

Refund Policy

Our refund policy reflects the nature of digital, instantly-delivered products while respecting your rights under Australian Consumer Law.

General Policy

The Pathway Discovery Pro report is a digital product delivered upon completion of the extended interview. Because the report is personalised and generated specifically for you, we generally do not offer refunds once the report has been generated and delivered.

When We Will Provide a Refund

We will offer a full refund in the following circumstances:

  • Technical failure — your payment was processed but your report was never generated due to a fault on our end
  • Duplicate payment — you were charged more than once for the same report
  • Pre-delivery cancellation — you paid but have not yet completed the extended interview (and therefore no pro report has been generated); refund requests in this case must be made within 48 hours of payment

How to Request a Refund

Email us at [email protected] with your report ID (found in your email or report URL) and a brief description of the issue. We aim to respond within 2 business days. Approved refunds are processed back to the original payment method via Stripe and may take 5–10 business days to appear.

Australian Consumer Law

Nothing in this policy excludes, restricts, or modifies any consumer guarantee, right, or remedy available to you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). If you are entitled to a remedy under the ACL, we will honour that entitlement regardless of the above.

Free Reports

Free reports have no associated payment and therefore no refund applies. If your free report was not generated correctly, please contact us and we will endeavour to resolve the issue.

Cookies & Data

We keep our data collection minimal. Here's exactly what we store in your browser and why.

What We Store Locally

Pathway Discovery uses browser localStorage (not cookies) to temporarily store your interview answers as you progress through the questionnaire. This means:

  • Your in-progress answers are saved locally so you don't lose them if you accidentally close the tab
  • This data never leaves your browser until you submit the interview
  • It is automatically cleared when your report is submitted
  • You can clear it at any time by clearing your browser's localStorage for this site

Essential Cookies

We may set minimal functional cookies necessary for the service to operate, such as maintaining your session state. These are strictly necessary cookies — they are not used for tracking, advertising, or profiling.

Third-Party Cookies

When you proceed to payment, Stripe's checkout process may set cookies governed by Stripe's Privacy Policy. We have no control over these cookies.

We do not use Google Analytics, Facebook Pixel, or any advertising or behavioural tracking technologies on this site.

Your Control

You can manage or delete cookies through your browser settings at any time. Disabling all cookies may affect the functionality of the payment step, but will not prevent you from completing the interview or accessing a previously generated report via its direct link.
